3.3 REGULATORY STATUS <br /> The review of selected regulatory agency databases for documented environmental concerns on the Site, <br /> or in close proximity to the Site, was conducted by NOA as part of the Phase I ESA and verified for this <br /> plan. As mentioned above, D.H. Winn Trucking, operating at the southern parcel of the Site, is listed as a <br /> RCRIS small quantity generator of hazardous waste, as a shipper of various wastes, and as an operator of <br /> a 10,000-gallon UST for storing waste oil. The RCRIS listing notes that the facility is not reported as a <br /> hazardous waste treatment, storage, or disposal facility and that no RCRA violations have been found at <br /> the facility. However, San Joaquin County Environmental Health Division issued a Notice to Comply, <br /> dated November 18, 1999, as a result of a site inspection that found the following waste storage and <br /> handling violations: <br /> • oil spilled on the ground inside the building near the filter draining bin and ASTs; <br /> • used oil in excess of 100 kilograms stored onsite for longer than 90 days; <br /> • improper labeling of used oil tank and drum of absorbent material; <br /> • waste containers not kept closed, and used absorbent not stored in a container capable of being <br /> closed and sealed; and <br /> • inadequate spill prevention and contingency plan. <br /> A spill of 105 gallons of diesel fuel at the southern parcel was reported to the County on August 17, 1995. <br /> The spill report indicates that the spilled fuel was washed into the storm drain and ditch in front of the <br /> adjacent school property to the south. The report indicates that the majority of diesel and contaminated <br /> soil and water was removed and that the storm-drain would be re-flushed. <br /> In 1996, D.H. Winn Trucking was notified of a violation relating to UST registration regulations. In <br /> December 1998, the UST and some moderately-contaminated soil (TPH-D at concentrations up to 1,900 <br /> mg/kg) were removed from the Site. One soil sample from the bottom of the excavation contained 3.9 <br /> mg/kg of TPH-D and no detectable BTEX, and another soil sample from the bottom of the excavation <br /> contained 6.7 ug/kg of xylenes and no other detectable constituents. Based on this data, the County <br /> issued a letter,dated November 3, 1999, stating that no further action was required at that time. <br /> 3.4 PHYSICAL AND ENVIRONMENTAL CHARACTERISTICS <br /> The information presented in the following subsections is from the Phase I ESA report [NOA, 2002] as <br /> referenced and from independent confirmation and research conducted by URS. <br /> 3.4.1 Site Topography <br /> Based on a review of the USGS 7.5 Minute Topographic Series, Lockeford Quadrangle Map, the Site has <br /> a surface elevation of approximately 100 feet above mean sea level. The regional surface topography <br /> slopes downward gently to the southwest at about five feet per mile,except about '/a mile northwest of the <br /> Site, where the land surface drops abruptly about 40 feet to the floodplain of the Mokelumne River. The <br /> river itself appears on the quadrangle map about one mile northwest of the Site.
