No person may own or operate an UST unless a permit for <br /> its operation has been issued by the local agency to the owner or operator of the UST system . Immediately obtain a <br /> permit to operate a UST system from the EHD . An " Operating without a Permit' penalty applies . <br /> This is a Class I violation. <br /> 102 HSC 25284 (a) (3) (A)/(B ) No written agreement between tank owner and tank operator to monitor the tank system . <br /> The annual operating permit is not issued to the current operator and there is no written agreement between the <br /> person who was issued the permit and the operator to monitor the UST system . If a permit is issued to a person <br /> other than the operator of the tank , that person shall enter into a written agreement with the operator of the tank to <br /> monitor the UST system . Immediately submit a copy of this written agreement to the EHD . Alternatively, log into <br /> CERS , upload the written agreement , and submit for review by the EHD . <br /> This is a minor violation . <br /> 103 HSC 25292 . 21 25299 . 30 Failure to submit and maintain complete and current financial responsibility documents . <br /> Current Financial responsibility documents have not been submitted to the EHD . Current financial responsibility <br /> documents are required to be submitted annually. Immediately log into the California Environmental Reporting <br /> System (CERS) at http : //cers . calepa . ca . gov/, and upload the required documents . <br /> This is a minor violation. <br /> 104 CCR 2711 UST operating permit application for facility and tank information not submitted or current . <br /> UST Facility Operating Permit Application BOE number is incorrect. The number listed is shown on the CDTFA <br /> website as closed and not valid . Immediately log into CERS , update the required information , and submit for review <br /> by the EHD . <br /> This is a repeat violation , Class II . <br /> 105 CCR 2632 (d ) (1 ) , 2634 (d ) Failed to have an approved UST monitoring plan . <br /> The monitoring plan is not current and/or not approved by the EHD . The monitoring plan for all of the tanks <br /> incorrectly list the name of the person having responsibility. The monitoring plan must be uploaded to the California <br /> Environmental Reporting System (CERS) .
