A permit to operate the UST system has not been issued. No person may own or operate an UST unless a permit for its operation has been issued by the local agency to the owner or operator of the UST system. Immediately obtain a permit to operate a UST system from the EHD. An"Operating without a Permit' penalty applies. This is a Class I violation. 102 HSC 25284(a)(3)(A)/(B) No written agreement between tank owner and tank operator to monitor the tank system. The annual operating permit is not issued to the current operator and there is no written agreement between the person who was issued the permit and the operator to monitor the UST system. If a permit is issued to a person other than the operator of the tank, that person shall enter into a written agreement with the operator of the tank to monitor the UST system. Immediately submit a copy of this written agreement to the EHD. Alternatively, log into CERS, upload the written agreement, and submit for review by the EHD. This is a minor violation. 103 HSC 25292.2, 25299.30 Failure to submit and maintain complete and current financial responsibility documents. Current Financial responsibility documents have not been submitted to the EHD. Current financial responsibility documents are required to be submitted annually. Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, and upload the required documents. This is a minor violation. 104 CCR 2711 UST operating permit application for facility and tank information not submitted or current. UST Facility Operating Permit Application BOE number is incorrect. The number listed is shown on the CDTFA website as closed and not valid. Immediately log into CERS, update the required information, and submit for review by the EHD. This is a repeat violation, Class II. 105 CCR 2632(d)(1), 2634(d) Failed to have an approved UST monitoring plan. The monitoring plan is not current and/or not approved by the EHD. The monitoring plan for all of the tanks incorrectly list the name of the person having responsibility. The monitoring plan must be uploaded to the California Environmental Reporting System (CERS). Immediately log into CERS, make the necessary changes, and submit for review by the EHD. This is a minor violation.
