The following is an itemized list of underground storage tank violations that have not <br /> been addressed for AM PM HAMMER/15 FOOD#83113 as of January 29, 2019. <br /> Open violations from May 24,2018 inspection <br /> Violation#115-Failed to submit to EHD notification of designated operator identification or change w/in 30 <br /> days. <br /> A new designated operator(David Turner)was hired on June 2017 and notification was not provided to the EHD <br /> within 30 days of the change. Any changes shall be reported to the EHD within 30 days. Immediately log into the <br /> California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov and upload the notification <br /> identifying all the designated operators for this facility. <br /> Violation#121 -Failed to submit a written response within 30 days of receiving an inspection report. <br /> An inspection was last done on 05/25/17 and an inspection report was issued identifying information to be submitted <br /> to bring this site into compliance. This information was required to be submitted by 6/24/17. This information has <br /> not been received resulting in a non-compliant status for this facility. An operator that receives an inspection report <br /> shall have 30 days to submit a written response that includes a statement documenting corrective actions taken or <br /> proposing corrective actions which will be taken. Ensure that a written response documenting corrective actions <br /> taken or proposed is submitted within 30 days of receiving an inspection report. <br /> Remaining violations include: <br /> 1) Failed to inform the EHD of designated operator identification or change within 30 days. A new designated <br /> operator(DO), Shawn Rodriguez, completed the DO monthly inspection reports from May 2016 through April 2017 <br /> and notification was not provided to the EHD within 30 days of the change.Any changes shall be reported to the <br /> EHD within 30 days. Immediately log into the California Environmental Reporting System (CERS)at <br /> http://cers.calepa.ca.gov and upload the notification identifying all the designated operators for this facility. <br /> 2) Designated operator employee training not performed or log not kept. <br /> The designated operator failed to list the"Hire Date"for Sally Moreno and there is no record of recent training for <br /> Wes Parkinson.The designated operator shall train facility employees for which he or she is responsible in the <br /> proper operation and maintenance of the UST system once every 12 months.The training shall include, but is not <br /> limited to: <br /> 1. Operation of the UST system in a manner consistent with the facility's best management practices <br /> 2. Employee's role with regard to monitoring equipment as specified in the facility's monitoring plan <br /> 3. Employee's role with regard to spills and overfills as specified in the facility's response plan <br /> 4. Name of the contact person(s)for emergencies and monitoring equipment alarms <br /> Ensure that employees have been trained by the designated operator, maintain the list on site, and submit a copy of <br /> the training records to the EHD. <br /> Violation#209-Designated operator did not inspect all required items and/or the inspection reports not <br /> completed. <br /> 1)The designated operator failed to document all the alarms from the attached alarm history on the 8/23/17 <br /> designated operator monthly inspection report and failed to check that they were responded to appropriately. The <br /> missing alarms include: an L6 91 STP sump fuel alarm occurring on 8/2/17. <br /> 2)The designated operator put the incorrect date on the July 25th, 2017 designated operator monthly inspection <br /> report as 7/25/19 and failed to attach a copy of the alarm history. <br /> During the monthly inspection,the designated operator shall review the alarm history for the previous month, check <br /> that each alarm was documented and responded to appropriately, and attach a copy of the alarm history with <br /> documentation taken in response to any alarms to the monthly report. Ensure that designated operators performing <br /> monthly inspections at this facility are including all of the required information on the reports. <br /> Page 1 of 2 <br />
