We have, and continue, <br /> to research Mr. Olivera's management practices at other locations. He has demonstrated <br /> a pattern of wearing out facilities and then walking away from them. <br /> 1. The applicant previously operated a poultry facility at 4140 Canada Road, Gilroy, <br /> CA. This operation closed in September of last year. We have attached <br /> documents from Santa Clara County Environmental Resources Agency(May 6, <br /> 2003) showing the initial problems and weekly inspections. Continued facility <br /> inspections more than a year later show that many of the same operating problems <br /> still persisted. A Gilroy Dispatcharticle(August 23, 2005) describes conditions <br /> on the property when it was returned to the owner. We have yet to complete our <br /> review of the full Santa Clara County public files. Ben Gale, Director, <br /> Environmental Health Department (408- 918-1955)has indicated our review <br /> will take several days;they are still assembling this material for us. <br /> 2. We recently visited the former Olivera Egg Ranch facility at 17252 S. Ward <br /> Road, Los Banos, CA. Merced County records indicate the Olivera Family <br /> Limited Partnership sold this property December 8, 2005. We do not know the <br /> possession arrangement between the Hostetler Investments (buyer) and Olivera <br /> (seller),however it is now more than five months since the sale. As of last week <br /> (May 18, 2006)the site is still a source of flies, manure and odors. (See attached <br /> photos.) <br /> Pg I of 2 <br />
