• i <br /> 1 4. At the May 19 meeting,French Camp residents expressed concern over the odors and <br /> 2 flies that were present on the Olivera Egg Ranch. <br /> 3 5. In response to the May 19 meeting, I had a discussion with Ed Olivera, owner of the <br /> 4 Olivera Egg Ranch. I expressed concern regarding the current load on the manure lagoon. <br /> 5 <br /> 6. Ed Olivera and I discussed the possibility of dredging the manure lagoon sludge and <br /> 6 <br /> 7 grit. This is an option that Ed Olivera had brought up several months in the past. Although there was <br /> g concern that such an operation would actually increase the odors and flies on the facility, the goal <br /> 9 would be to lighten the load on the pond over time. I told Ed Olivera to start right away. <br /> 10 7. At no point during my discussions with Ed Olivera was there ever any mention of <br /> II <br /> litigation with Plaintiffs. <br /> 12 <br /> 13 8. The purpose of the operation to dredge the manure lagoon was to reduce odors and flies <br /> 14 over time, an issue of immediate importance to the local residents and the Environmental Health <br /> 15 Department. <br /> 16 9, It is my recollection that the work could not commence until the week after the <br /> 17 Memorial Day holiday, May 25, 2009, because workers capable of performing the work would be <br /> 18 <br /> unavailable during that time. <br /> 19 <br /> 20 10. Prior to the commencement of the dredging, new PVC piping had been installed that <br /> 21 merely extended the discharge points of manure from the southern houses into the lagoon. The affect <br /> 22 was a discharge of manure into a more northern location of the lagoon,out of the way for where much <br /> 23 of the dredging needed to take place on the southern portion of the lagoon. Other than the new PVC <br /> 24 <br /> extensions, the prior PVC piping remained intact. <br /> 25 <br /> 26 11. The operation to dredge the manure lagoon of sludge and grit began on Tuesday,June <br /> 27 2 and ended on Monday, June 8.
