1 12. The excavator used to perform the dredging work had been brought to the Olivera Egg
2 Ranch on June 1, 2009. This excavator left the facility on June 8, 2009.
3 13. On June 2, 2009, I observed sludge and grit removed from the manure lagoon and
4 placed in an enclosed area with a berm.
5
14. Beginning on June 3, the excavator would dump sludge and grit removed from the
6
7 manure lagoon into trucks that would transport the materials to a secondary lagoon located on the
8 facility. No truck removed materials from the manure lagoon to any location offsite. All sludge and
9 grit was placed either on a flat area south of the lagoon or in the secondary lagoon.
10 15. After the conclusion of the work on June 8,2009,I continued to visit the Olivera Egg
11
Ranch two to three times per week for a period of approximately three weeks. I would visit for
12
13 periods of time up to one hour. The purpose of my visits was to observe Olivera's handling of the
14 sludge and grit that had already been removed from the lagoon. I observed work intended to spread
15 the materials and break it up so that it could eventually dry out.
16 16. At no point during this period of time was I aware of any work that had been performed
i
17
after daytime business hours or in the middle of the night. The excavator used to perform the dredging
18
had been removed from the Olivera Egg Ranch on June 8 and did not return.
19
20 17. Ammonia is the volatile form of nitrogen. If you stir it up,the emissions will spike and
21 odors will be stronger. This would make conditions at the Olivera Egg Ranch worse in the short term
22 and possibly better in the long term.
23 I declare under penalty of perjury under the laws of the State of California and the United
24
States of America that the foregoing is true and correct.
25
26 Executed this_st day of August, 2009, in , California.
27
Robert McClellon
28
PORTER SCOTT
350 University Ave,Suite 200 3
Sacramento,CA 95925
TEL:916.92......
.1aRI
PAX:916.927.9706 007 962.WPD DECLARATION OF ROBERT MCCLELLON
W—Porterscott.com
