5. This Board finds and determines that the previously certified EIR is <br /> complete and adequate in scope and was completed in compliance with CEQA, <br /> the State CEQA Guidelines, and the Kern County Guidelines for implementation <br /> thereof; and that this Board fully reviewed and considered the information in the <br /> each with respect to the project described, and the related proposed Mitigation <br /> Measure Monitoring Program is adopted (Exhibit "C"). <br /> 6. This Board finds and determines that the implementation of the <br /> proposed clarification to mitigation measures would not result in any significant <br /> environmental impacts, pursuant to CEQA Section 15074.1. A public hearing <br /> has been held that identified the proposed clarifications as required. It is the <br /> Lead Agency's determination that implementation of the proposed clarifications <br /> are considered equivalent and more effective toward the mitigation of impacts <br /> and in full compliance with CEQA. . <br /> 7. This Board finds and determines the effect upon the environment of <br /> such project and the activities and improvements which may be carried out <br /> thereunder will not interfere with maintenance of a high-quality environment now <br /> or in the future. Mitigation measures have been incorporated from the previously <br /> certified EIR as conditions of approval, and the adopted Mitigation Measure <br /> Monitoring Program specifies the required steps to satisfy each mitigation <br /> measure. <br /> 8. The fee required by Fish and Game Code section 711.4 was <br /> previously required for the processing of the EIR for an earlier approval <br /> proceeding connected with this project, and under section 711.4(g), this Board <br /> finds that the project is not tiered or phased, and separate environmental <br /> documents or review by the Department of Fish and Wildlife is not required, and <br /> based on the public interpretation of these statutes by the Department of Fish <br /> and Wildlife staff, find this approval and related Notice of Determination exempt <br /> from the payment of the otherwise applicable fee. <br /> 9. This Board finds and determines the project is consistent with the <br /> goals and policies of the Kern County General Plan: <br /> a. because the applicant will submit closure plans and financial <br /> assurance estimates to guarantee closure. Closure/Post Closure maintenance <br /> plans and financial assurance are required as part of the Solid Waste Facility <br /> Permit through the Integrated Waste Management Board and as enforced by the <br /> Local Enforcement Agency, Environmental Health Services; <br /> 4 <br />
