b. because the solid waste disposal facility will be protected from <br /> encroachment of incompatible land uses and intensive urban development <br /> through the Map Code 3.4.1 (Solid Waste Disposal Facility Buffer) and the 2.10 <br /> (Nearby Waste Facility) designations which protect up to 1,320 feet around the <br /> permitted disposal area. The buffer has been approved to meet the intent of the <br /> policies of the General Plan as proposed on the Appendix E map; <br /> C. because the project has been amended through the County's <br /> Environmental Impact Report process to include consideration of fiscal impacts <br /> of the development proposal on public services, in this case, the County solid <br /> waste services. Mitigation is included to mitigate public services impacts to less <br /> than significant and to be consistent with the policies of the Kern County General <br /> Plan; <br /> d. because the project met all of the decision procedure criteria for <br /> sitting solid waste facilities as established in Appendix E (Solid Waste Disposal <br /> Facilities Guidelines) of the Kern County General Plan; <br /> e. because the project will provide for a land use that offers a variety <br /> of employment opportunities and enhances the County's economic assets to <br /> allow the capture of regional growth; and <br /> f. as a traffic study/analysis for the proposed project was submitted <br /> that analyzed the status of facility access roads and the need to upgrade these <br /> roads. The project proponent will, as a mitigation measure included in the project <br /> EIR, pay the pro-rata share of the upgrading of Holloway Road due to increased <br /> heavy truck traffic. An amount has been calculated by the Kern County Roads <br /> Department and is included as a mitigation measure and a condition of a <br /> Conditional Use Permit. <br /> 10. This Board finds and determines that in accordance with Senate Bill <br /> 18 and the California Tribal Consultation Guidelines, the appropriate Indian tribes <br /> were consulted with respect to the project's potential impacts on Native American <br /> Places, features, and objects and provided an opportunity for review and <br /> consultation. <br /> 11. The Board approves the project as requested by the Applicant. <br /> 12. The Planning and Community Development Director shall cause <br /> appropriate notations to be entered in all documents and maps which embody <br /> the Kern County General Plan and the elements thereof in order to show such <br /> amendments. <br /> 5 <br />
