After
completing the inspection, you provided us with an amended Inspection Report on October 26,
2018, which listed each potential violation and requested documentation of corrective actions,
along with a Return to Compliance Certification.
This letter provides our response to each of the potential violations, including corrective actions
where necessary. The completed/certified Return to Compliance Certification Form is provided
as Attachment 1 to this letter. For ease of review, a brief summary of each potential violation is
provided, followed by Pactiv's response and corrective action, if needed.
102
Dried lacquer was observed on the ground leaking from a 270 gallon tote. if multiple waste
streams are combined for disposal, each stream needs to have a complete hazardous waste
determination done at the point of generation.
Pactiv Response: Pactiv has determined this waste stream is non -hazardous by using process
knowledge and information from the SDS for the hazardous waste determination. SDS is
included as Attachment 2.
Forklifts are serviced by Watts. According to invoices, coolant waste was generated. No
disposal records for this waste were observed during the inspection.
Pactiv Response: Pactiv will retain forklift coolant waste the next time it is generated by
Watts for a complete hazardous waste determination. If the waste is deemed hazardous,
Pactiv will immediately begin managing the waste according to hazardous waste regulations.
