SAN J O A Q U I N Environmental Health Department <br /> AMENDED <br /> 9/28/2020 <br /> Hazardous Materials Program Inspection Report <br /> Facility Name: Facility Address: Date: <br /> DELTA BLUEGRASS CO 1 1030 S ARGONAUT, STOCKTON September 24,2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 7 HSC 25505(a)(3) Failed to electronically submit an adequate ER procedures for a release or threatened release. <br /> The emergency response procedures have not been submitted for 2018, 2019, and 2020. <br /> A business plan shall include the following emergency response procedures for a release or threatened release of <br /> hazardous materials, including, but not limited to,the following: <br /> -Immediate notification of local emergency personnel and the Environmental Health Department(EHD) <br /> -Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property,or the environment <br /> -Evacuation plans and procedures, including immediate notice, for the site <br /> Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, upload the <br /> correct or updated information, and submit to the EHD for approval. <br /> This is a repeat violation, Class II. <br /> 8 HSC 25505(a)(4) Failed to establish and electronically submit a reasonable or an adequate training program. <br /> A training program has not been submitted for 2018, 2019, and 2020. <br /> Training programs for all employees and annual training, including refresher courses,shall include familiarity with <br /> the facility's Emergency response plans and procedures in the event of a release or threatened release of a <br /> hazardous material.Training shall cover, but not limited to, all of the following: <br /> (A)Immediate notification contacts to the appropriate local emergency response personnel and to the <br /> unified program agency. <br /> (B)Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment. <br /> (C) Evacuation plans and procedures, including immediate notice, for the business site. <br /> These training programs may take into consideration of each employee. Immediately prepare or update the facility's <br /> training program, log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, <br /> upload the correct or updated information, and submit to the EHD for approval. <br /> This is a repeat violation, Class Il. <br /> 9 HSC 25508(a)(1) Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br /> HMBP was not submitted for 2018, or 2020. HMBP submittal for 2019 was incomplete. The business only submitted <br /> the facility information but not hazardous material inventory or emergency response or training plans. <br /> The business plan information has not been reviewed and resubmitted in the California Environmental Reporting <br /> System (CERS)annually. The submittal was not completed by 2018, 2019,and 2020. The hazardous materials <br /> inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of <br /> the previous year.
