SAN WO U I N Environmental Health Department <br /> AM LADED <br /> 9/28/2020 <br /> Hazardous Materials Program Inspection Report <br /> Facility Name: Facility Address: Date: <br /> DELTA BLUEGRASS COT1030 S ARGONAUT, STOCKTON September 24,2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. <br /> Employee training records were not available during time of inspection for the last three years. <br /> The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual <br /> refresher training.All employees shall be trained in safety procedures in the event of a release or threatened release <br /> of a hazardous material, including, but not limited to, familiarity with the following plans and procedures: <br /> (A)Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br /> program agency. <br /> (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property,or the environment. <br /> (C) Evacuation plans and procedures, including immediate notice,for the business site. This training shall be <br /> documented electronically or by hard copy and shall be made available for a minimum of three years. <br /> Immediately provide employee training for appropriate personnel and submit a copy of the training records to the <br /> EHD. <br /> This is a repeat violation, Class II. <br /> 12 HSC 25505(c) Failed to have the HMBP readily available to facility or EHD personnel. <br /> HMBP was not available to facility or EHD staff at time of inspection. <br /> Facility could not provide the Emergency Response Plan and the Chemical inventory upon request. The emergency <br /> response plans and procedures,the inventory of information required by this article, and the site map required by <br /> this section shall be readily available to personnel of the business or the unified program facility with responsibilities <br /> for emergency response or training pursuant to this section. Immediately make arrangements to have the business <br /> plan readily available for review. <br /> This is a repeat violation, Class II. <br /> Overall Inspection Comments: <br /> The inspection report has been amended by San Joaquin County EHD. This inspection report will replace the <br /> initial inspection report, provided to the facility on the day of the inspection. Violation#2 was accidentally marked <br /> during the inspection. Violation#2 has been removed from the inspection report. Violation#9 was amended to <br /> provide more accurate information. Violation#11 was amended to remove repeated information. <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, by October 24, 2020. <br /> To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br /> of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br /> ($152).
