The following is an itemized list of hazardous waste violations that have not been addressed for EL CAMINO TIRES (WILSON) as of December 23, 2020. Open violations from October 02, 2020 inspection Violation#113-Failed to keep copies of consolidated manifesting receipts for three years. OBSERVATION: The facility could not provide all of the consolidated manifest receipts for hazardous waste transported from the site from 10/2/2017-1/1/2020 for used oil, oily absorbent, and paper and metal oil filters. According to the manager, Ivan Montijo, the records before 2020 were kept in a warehouse that caught on fire and he was not able to locate the documents. REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. This period of retention is extended automatically during the course of any unresolved enforcement action regarding the regulated activity or as requested by the department or a certified unified program agency. CORRECTIVE ACTION: Immediately locate a copy of all consolidated manifest receipts for all hazardous waste from 10/2/2017-1/1/2020 for used oil, oily absorbent, and paper and metal oil filters.. Maintain the records on-site for three years from the date of shipping and provide a copy to the San Joaquin County Environmental Health Department(EHD). If the receipts cannot be found, provide a statement to the EHD that future receipts will be maintained on-site for three years. ❑ This violation was corrected ❑This violation will be corrected by(date): ❑ Supporting documents included Describe actions taken or will be taken to correct violation: Violation#301 -Facility not maintained to minimize the release of a hazardous waste. OBSERVATION: In the east side of the shop,the paper and metal oil filter containers were overfilled and several filters were observed on the ground and other equipment. REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous waste constituents to air, soil, or surface water which could threaten human health or the environment. CORRECTIVE ACTION: Immediately clean the spilled paper and metal oil filters. Manage the waste according to Title 22 California Code of Regulations for hazardous waste.
