The following is an itemized list of hazardous waste violations that have not been <br /> addressed for EL CAMINO TIRES (WILSON) as of December 23, 2020. <br /> Open violations from October 02, 2020 inspection <br /> Violation#113-Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION: The facility could not provide all of the consolidated manifest receipts for hazardous waste <br /> transported from the site from 10/2/2017-1/1/2020 for used oil, oily absorbent, and paper and metal oil filters. <br /> According to the manager, Ivan Montijo, the records before 2020 were kept in a warehouse that caught on fire and <br /> he was not able to locate the documents. <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Immediately locate a copy of all consolidated manifest receipts for all hazardous waste <br /> from 10/2/2017-1/1/2020 for used oil, oily absorbent, and paper and metal oil filters.. Maintain the records on-site <br /> for three years from the date of shipping and provide a copy to the San Joaquin County Environmental Health <br /> Department(EHD). If the receipts cannot be found, provide a statement to the EHD that future receipts will be <br /> maintained on-site for three years. <br /> ❑ This violation was corrected ❑This violation will be corrected by(date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#301 -Facility not maintained to minimize the release of a hazardous waste. <br /> OBSERVATION: In the east side of the shop,the paper and metal oil filter containers were overfilled and several <br /> filters were observed on the ground and other equipment. <br /> REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment. <br /> CORRECTIVE ACTION: Immediately clean the spilled paper and metal oil filters. Manage the waste according to <br /> Title 22 California Code of Regulations for hazardous waste. Submit a statement and supporting documentation to <br /> the San Joaquin County Environmental Health Department describing the storage and final disposition of the <br /> cleaned up waste. <br /> ❑ This violation was corrected ❑This violation will be corrected by(date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Page 2 of 5 <br />
