The following is an itemized list of hazardous waste violations that have not been <br /> addressed for SMART TECH DIESEL REPAIR as of December 08, 2020. <br /> Open violations from October 15, 2020 inspection <br /> Violation#507-Failed to conduct daily inspections of hazardous waste tank system and maintain records <br /> onsite. <br /> OBSERVATION: The facility has a hazardous waste tank but does not have three years of complete daily tank <br /> inspection records. According to the president,Amandeep Singh, the facility inspects the tank daily but does not <br /> document it. <br /> REGULATION GUIDANCE: <br /> (a)The owner or operator shall inspect,where present, at least once each operating day: <br /> (1)overfill/spill control equipment(e.g.,waste-feed cutoff systems, bypass systems, and drainage systems)to <br /> ensure that it is in good working order; <br /> (2)the aboveground portions of the tank system, if any, to detect corrosion or releases of waste; <br /> (3)data gathered from monitoring equipment and leak-detection equipment, (e.g., pressure and temperature <br /> gauges, monitoring wells)to ensure that the tank system is being operated according to its design; <br /> (4)the construction materials and the area immediately surrounding the externally accessible portion of the tank <br /> system including secondary containment structures(e.g., dikes)to detect erosion or signs of releases of hazardous <br /> waste (e.g.,wet spots, dead vegetation); and <br /> (5)for uncovered tanks,the level of waste in the tank, to ensure compliance with section 66265.194(b)(3). <br /> (c)The owner or operator shall document in the operating record of the facility an inspection of those items in <br /> subsection (a)of this section. <br /> CORRECTIVE ACTION: Immediately start conducting and documenting complete daily hazardous waste tank <br /> inspections. Provide a corrective action statement and supporting documentation to the San Joaquin County <br /> Environmental Health Department(EHD)within 30 days. <br /> ❑ This violation was corrected ❑This violation will be corrected by(date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#601 -Stored hazardous waste on site longer than 90 days without a permit or authorization. <br /> OBSERVATION: In the hazardous waste storage area, one 275 gallon plastic tote containing used antifreeze was <br /> missing a hazardous waste label. <br /> REGULATION GUIDANCE: <br /> (a)a generator may accumulate hazardous waste on-site for 90 days or less <br /> (b)The beginning of the 90 day period is determined as follows: <br /> (1)if the generator does not generate more than 100 kilograms of hazardous waste or one kilogram of acutely <br /> hazardous waste(listed in section 66261.33(e))or one kilogram of extremely hazardous waste during any calendar <br /> month, the 90 day period begins on the date the generator has accumulated 100 kilograms of hazardous waste or <br /> one kilogram of acutely hazardous waste or one kilogram of extremely hazardous waste; <br /> (2)if the generator generates more than 100 kilograms of hazardous waste or one kilogram of acutely hazardous <br /> waste or one kilogram of extremely hazardous waste during any calendar month,the 90-day period begins on the <br /> first date on which any amount of hazardous waste begins to accumulate during that month. <br /> CORRECTIVE ACTION: Immediately dispose of the hazardous waste stored on site greater than 90 days in <br /> compliance with Title 22 California Code of Regulations. Provide a corrective action statement and a copy of the <br /> disposal records to the San Joaquin County Environmental Health Department(EHD)within 30 days. <br /> Page 12 of 14 <br />
