Central Valley Waste Seffies <br /> Page 2 <br /> You stated that the facility is storing some recyclable material for longer than 72 hours. The <br /> recyclable material is exempt from regulation under Title 14, California Code of Regulations <br /> (CCR), if it meets the three-part test. The recyclable material is not exempt from regulation <br /> under San Joaquin County Ordinance 2887 and must be removed every seven days. The facility <br /> operators have assured me that the recyclable material does get processed. This item will <br /> continue to be monitored and the facility will be cited for non-compliance if confirmed. <br /> Central Valley Waste Services has submitted a revised Transfer Processing Report (TPR) <br /> indicating the changes in equipment at the facility. The TPR was reviewed by the EHD and <br /> found to be adequate. The changes mentioned in the TPR are exempt under the CEQA <br /> guidelines, Title 14, CCR, Section 15061 (b) (3). The California Integrated Waste Management <br /> Board (CIWMB) has been notified of the changes at the facility. The TPR and the permit are <br /> currently being reviewed by the CIWMB. <br /> The permit review notification requirements are found in Title 27, CCR, Section 21660 (see <br /> attached). This section requires that the LEA maintain a list of all permits currently under <br /> review and that it be made available during normal business hours. This section also requires <br /> that the LEA mail written notice of an application to every person that has submitted a written <br /> request for such notice. <br /> The EHD notified you in writing of the solid waste permit application on May 22, 2002. <br /> Additionally, I phoned your office on May 22, 2002, to request your e-mail address and inform <br /> your office personnel that the letter was coming. Your office indicated that the e-mail would be <br /> printed and made available to you when you arrived in the office. The letter was sent via e-mail <br /> and U. S. Mail. <br /> The permit revision will be heard by the CIWMB during one of the Board's Committee <br /> Meetings; however, I am not sure of the date. When it becomes available, I will notify you, or <br /> you can track the information on the CIW 's Website (www.ciwmb.ca.gov).
