Stockton Verde MHP - 3 - 23 December 2022 <br /> Considering the NOA was issued with the understanding the plant would be completed <br /> no later than May of 2021, the failure to construct, operate and submit reports in <br /> accordance with the NOA issued by the Central Valley Water Board is an egregious <br /> non-action by Stockton Verde MHP. The ongoing discharge of wastewater in violation of <br /> the effluent limit in the NOA into the unpermitted wastewater ponds and seepage pits is <br /> a violation of the NOA and General Order. The continued discharge, lack of monitoring <br /> and lack or reporting will only increase Stockton Verde MHP's exposure to higher <br /> penalties. It is in the best interest of Stockton Verde MHP to immediately cease the <br /> discharge and off haul it to a permitted facility and submit the delinquent reports. Staff <br /> will continue to evaluate the status of this discharge and will recommend further <br /> enforcement if compliance is not achieved. Please understand that Provision E2(u) of <br /> the SWRCB General Order outlines the Dischargers obligation to comply with the Order <br /> which states: "The fact that it would have been necessary to halt or reduce the <br /> permitted activity to maintain compliance with this General Order shall not be a defense <br /> for the Discharger's violations of the General Order." <br /> The requested submittal and all monitoring reports shall be converted to a searchable <br /> Portable Document Format (PDF) and e-mailed to <br /> centralvalleysacramento(i)..waterboards.ca.gov. The e-mail shall contain the following: <br /> (a) Stockton Verde MHP WWTF, (b) Non-15 Compliance Section, (c) Title and Date of <br /> the Report, and (d) CIWQS Place ID No. 872049.
