Stockton Verde MHP - 2 - 23 December 2022 <br /> Sludge Management Plan no later than 1 October 2021. Additionally, Monitoring and <br /> Reporting Program 2014-0153-DWQ-R5343 requires the Discharger to implement <br /> monitoring upon issuance of the NOA and submit quarterly and annual monitoring <br /> reports. A review of the Central Valley Water Board's files indicates that none of the <br /> technical or monitoring reports have not been submitted. <br /> Self-monitoring and timely reporting is the expectation of all Dischargers that have been <br /> issued a NOA by the Central Valley Water Board. Stockton Verde MHP has failed to <br /> submit the required monitoring reports, which is a violation of Monitoring Requirement <br /> 4.a. which states, "The Discharger shall comply with the MRP issued with the NOA, and <br /> any future revisions, as specified by the appropriate Regional Water Board's Executive <br /> Officer." In addition, the failure to submit the technical reports is another violation of the <br /> NOA. The noncompliance needs to be resolved by Stockton Verde, MHP forthwith. <br /> Currently, the Owners of Stockton Verde MHP are exposed to an administrative civil <br /> liability (i.e., monetary fine) for failure to submit the required reports as well as <br /> discharging by means not approved in the NOA. Under the California Water Code, <br /> Section 13268 the penalties for non-submittal accrue at a rate of $1,000 per day - per <br /> violation. Additional penalties can also be levied for the ongoing non-approved <br /> discharge of effluent to waters of the state (i.e., groundwater). The penalties for <br /> unauthorized discharge of wastewater are typically assessed at a per gallon rate, dating <br /> back to when the non-permitted discharge began. <br /> Post Inspection Update <br /> At the request of Central Valley Water Board staff, the Discharger's consultant <br /> submitted via e-mail a "punch list" of items that need to be completed before the WWTF <br /> can be started up and tested. Based on the list, the WWTF is not likely to be operating <br /> and meeting effluent limits for several months. <br /> Additionally, on 21 December 2022, the San Joaquin County Environmental Health <br /> Department informed Central Valley Water Board staff that despite the County's <br /> previous requests the Discharger has yet to apply for the county's system installation <br /> permit to complete construction of the WWTF. <br /> Staff Comments and Required Submittals: <br /> It is unclear why the Discharger Stockton Verde MHP has been unable to complete the <br /> plant and comply with the SWRCB General Order and NOA. Staff is unable to modify <br /> the requirements or compliance dates within the NOA. Central Valley Water Board <br /> compliance and enforcement staff can only identify the compliance issues and facilitate <br /> compliance within a timely manner. Therefore, Effective Immediately, Stockton Verde <br /> MHP shall submit quarterly monitoring reports and the annual report as required by <br /> Monitoring and Reporting Program WQ 2014-0153-DWQ-R5343. If construction of the <br /> new WWTF has not been completed or no discharge has occurred from the new <br /> WWTF, the report shall state so. The reports shall contain receipts for off hauling and <br /> disposal of waste at a permitted facility. <br />
