Sandip Singh [EH]
From: Tony Hamer <tonyhamer@me.com>
Sent: Thursday, September 5, 2019 4:44 PM
To: McClellon, Robert
Cc: Subbotnikova, Natalia; Sandip Singh [EH]
Subject: Re: Mulhair 19133 E. Liberty Road US Bank
Hi Robert,
You are telepathic as I was just writing you an email!
The opposing counsel was unsuccessful in attempting to stop the trial from proceeding, but they did add a few new requests. We
are working on them now.
The opposing counsel is requesting a discovery hearing on September 27th. We have all of their requests for information, and it
it possible I may have a few questions for you before then. Depositions are held in mid October. On or about December 27,
2019,The Honorable Carter Holly of the Superior Court of California for the County of San Joaquin will set a trial date. If the
information the opposing counsel receives during discovery is strong(it will be),they will settle before going to trial with this
egregious case.
So It looks like they have succeeded just in pushing things back a bit,but not by much.Given the price point of the Property,
the opposing counsel probably assumed the cost of going to trial alone would cause Mr. and Mrs.Gomez's to give up, lose the
Property, and US Bank,Ocwen, and Altisource would have successfully robbed them of much of their retirement savings and
avoided their responsibility to the SJC EHD to meet earlier Notices to Abate when they owned the Property.
Fortunately in this case, the law firm in San Francisco is one of the very best and doing this basically pro bono given the
magnitude of the injustice.
Please call or write if you have any questions at any time. Thank you so very much for your patience and understanding to date.
Best regards,
Tony S.
