Good Morning Robert,
Mr. and Mrs. Gomez have retained counsel and have documented the relevant facts of the case to file
suit against the seller, U.S Bank Trust N.A. and their agents,Altisource Portfolio Solutions and Ocwen
Financial.
The lawsuit will be filed shortly. Ultimately the named parties will pay in full for the environmental
damage done to the property while they acted as REO property management and Trustees to Mr. and
Mrs. Mulhair(Altisource), mortgage loan servicer(Ocwen) and lienholder(US Bank Trust N.A.).
Selling a property without disclosure of known environmental defects, and a purposeful intent to
conceal such facts, is fraudulent misrepresentation.
Were the case to go to trial, the parties would owe substantial punitive damages in addition to
compensatory damages. Therefore, it would be in their interests to settle the case with Mr. and Mrs.
Gomez to avoid punitive damages awarded at trial commensurate with their revenues.
The named parties would then follow your directions to the letter to abate all the issues your
department raised.
Please give me a call if you have further questions.
Best regards,
Tony S.
