1 AGREEMENT_ <br /> 2 THIS AGREEMENT, made and entered into this � <br /> _�� day of <br /> 3 V_', �l)f 1977, by and between the City of Stockton, a <br /> T <br /> 4 municipal corporation of the State of California, hereinafter <br /> 5 referred to as "City" , and the County of San Joaquin, a political <br /> 6 subdivision of the State of California, hereinafter referred to <br /> 7 as "County" , is for the use by County of the City ' s Regional <br /> 8 Wastewater Control Facilities and System. <br /> 9 RECITALS <br /> 10 This Agreement is predicated on the following facts: <br /> 11 A. Increases in population in the City of Stockton and <br /> 12 changes in requirements for wastewater treatment and disposal <br /> 13 have created an urgent need for additional facilities for the <br /> 14 .. transmission, treatment and disposal of. wastewater. <br /> 15 B. To protect the health and safety of its citizens , to <br /> 16 preserve and enhance their environment, and to provide for future <br /> 17 growth population in the metropolitan/regional area of Stockton , <br /> 18 the City intends to acquire, construct and expand facilities for <br /> 19 the transmission, treatment and the disposal of wastewater and <br /> 20 the disposal of the byproducts of wastewater treatment. <br /> 21 C. A special condition of wastewater tertiary treatment <br /> 22 project certification for award of Federal and State grants to <br /> 23 the City requires that City "shall provide regional treatment <br /> 24 capacity in the proposed facilities and furnish services to <br /> 25 area dischargers of wastewater based on fair and equitable con- <br /> 26 ditions. " <br /> 27 D. A special condition of an improvement and enlargement <br /> 0 CO. COUNSEL 17 <br />
