1 SECTION 11. CAPACITY SERVICE <br /> 2 A. Cost considerations as calculated for Capacity Ser- <br /> 3 vice are based upon an anticipated Peak Wet Weather flow of <br /> 4 1. 7 M. G.D. <br /> 5 Such capacity service is allocated in the Regional System <br /> 6 to the Hospital Complex. <br /> 7 B. Cost considerations of this Agreement anticipate a <br /> 8 normal institutional wastewater into the Regional System from <br /> 9 County sources. Such wastewater shall not exceed 250 mg/l <br /> 10 BOD (or equivalent COD or TOC) or 300 mg/l SS . <br /> 11 C. If County wastewater discharge exceeds the limits <br /> 12 established for Capacity Service, such increase may be dis- <br /> 13 charged into the Regional System only at an increased rate of <br /> 14 payment. Such excesses shall be subject to such charges, fees <br /> 15 and penalties as may be provided in the City' s rules and rate <br /> 16 structure that apply to any industrial user at that time. This <br /> 17 Section 11C. shall not be operative when the Capacity Service <br /> 18 is properly revised pursuant to the provisions of Section 12B <br /> 19 or 12C, which follow: <br /> 20 SECTION 12. REVISION OF CAPACITY SERVICE <br /> 21 After the effective date of beginning of operations , <br /> 22 Capacity Service shall be revised in the following ways : <br /> 23 A. When the responsibility for the collection and dis- <br /> 24 posal of sewage is transferred from County to City due to <br /> 25 annexations, the allocated Capacity Service shall transfer to <br /> 26 City . If an annexation is part of the Hospital Complex and <br /> 27 will continue to use portions of the Hospital Complex facilities <br /> 15 - <br /> • CO COUNSf.. 17 <br />
