I shall require that all. industrial users of the County ' s and <br /> 2 City ' s sewerage systems shall obtain City Industrial Waste <br /> 3 permits and provide the establishment of user charges including <br /> 4 the mandated recovery of Federal grant funds from industrial <br /> 5 users. it shall conform to requirements of the Federal Water <br /> 6 Pollution Control Act of 1972 and shall in essential details <br /> 7 conform to a sewer use ordinance that is mutually acceptable to <br /> 8 City and County. Nothing in this Agreement shall prevent <br /> 9 either City or County from adopting more restrictive standards . <br /> 10 D. Wastewater as discharged by County to Regional System <br /> 11 shall: <br /> 12 1. Meet requirements with respect to quality, character- <br /> 13 istics, and prohibited substances contained in the City ' s Sewer <br /> 14 Use Ordinance and applicable regulations , and <br /> 15 2 . Not contain undissociated hydrogen sulfide to the <br /> 16 extent that hazard of odor nuisance or damage to sewers and <br /> 17 other structures occurs at the point of discharge. County <br /> 18 shall bear the cost of any special facilities or treatment <br /> 19 required to overcome hazards from excessive sulfide demonstrated <br /> 20 to be contributed from a County system. <br /> 21 E. City shall notify County of actual or impending in- <br /> 22 fractions of the foregoing limitations and, if necessary, will <br /> 23 take appropriate legal action to obtain compliance . In the <br /> 24 event that noncompliance is determined to be the proximate <br /> 25 cause of failure of the Regional System to meet State or Federal <br /> 26 requirements, County may be held responsible for the cost of <br /> 27 the defense thereof and for penalties and damages or settlement. <br /> - 14 - <br /> 0 CO.
