<br />PA-1900284 – Informational Letters 13 <br />San Joaquin Valley Ai'" Poflutbn Control Distric t <br />District Reference No. 2021004 7 <br />February 4, 2021 <br />2b) District Rule 9510 (Indirect Source Review) <br />Page 3 <br />The purpose of District Rule 951 0 (Indirect Source Review) is to reduce the growth <br />in both NOx and PM1 0 emissions associated with development and transportation <br />projects from mobile and area sources associated with construction and ope ration <br />of development projects. The rule encourages clean air design elements to be <br />incorporated into the development project. In case the proposed project clean air <br />design elements are insufficient to meet t he targeted emission reductions, t he ru le <br />requires developers to pay a fee used to fund projects to achieve off-site emissions <br />reductions . <br />Per District Ru le 9510 (Indirect Source Review) section 4.4.3, a development project <br />on a faci lity whose primary functions are subject to District Rule 2201 or District Rule <br />2010 are exempt from the requirements of the rule . The District has revie wed the <br />information prov ided and has determined that the primary functions of this Project <br />are subject to District Rule 2201 (New and Modified Stati onary Source Re v iew <br />Rule) or District Rule 2010 (Permits Requ ired). As a result, District Rule 9510 <br />requirements and related fees do not apply to the Project referenced above. <br />2c) District Regulation VIII (Fugitive PM10 Prohibitions) <br />The Project will be subject to Regulation VII I. Information on how to comp ly wi th <br />Regu lation VIII can be found online at: <br />http://www.valleyair.o rg/busind/comply/PM10/compliance PM1 0htm. <br />2d) Other District Rules and Regulations <br />The Project may also be subject to the following District rules: Regulation VIII, <br />(Fugitive PM10 P roh ibitions), Rule 4102 (Nuisan ce), Rule 4601 (Arc hitectural <br />Coatings), and Rule 4641 (Cutback, Slow Cure, and Emulsified Asphalt, Pa ving <br />and Maintenance Operations). In the event an ex isting building will be re novated , <br />partially demolished or removed, the project may be subject to District Ru le 4002 <br />(National Emission Standards for Hazardous Air Pollutants). <br />The list of rules above is neither exhaustive nor exclusive . Current District rules <br />can be found online at: www.valleyair.org/rules/1ruleslist.ht m.
