x Environmental Health Department <br /> SANJUII <br /> 6A� —COUNTY <br /> `c v Greatrxess grows here, <br /> Aboveground Petroleum Storage Act Compliance Review Report <br /> Facility Name: Facility Phone: Date: <br /> Shell Oil Products US-Stockton Terminal 209 466-6941 June 30 2021 <br /> Facility Address: CERS ID: <br /> 3515 Navy Dr Stockton CA 95203 10157477 <br /> Inspection Contact: Title: Phone: <br /> Richard Bronson Terminal Manager (310)816-6056 <br /> VIOLATIONS <br /> The following non-inspection related violations listed below from the California Health and Safety Code(HSC), California Code of <br /> Requlations(CCR)and/or the Code of Federal Requlations(CFR)were found. <br /> #102 HSC 25270.4.5(a) Failed to prepare a written SPCC Plan in accordance with CFR Part 112 <br /> OBSERVATIONS:This facility has a Spill Prevention, Control, and Countermeasure(SPCC) Plan which was not <br /> implemented as required.The SPCC plan indicated that the AG-8 tank is to be inspected using API-653 standard. The AG-8 <br /> tank was inspected on March 2, 2015, using API-653 standard, and this inspection report indicated that the next formal <br /> API-653 external inspection should be conducted within five years and no later than March 2020. This tank was not <br /> inspected, as required, by March 2020. Mr. Richard Bronson provided information stating that since this tank of a smaller <br /> capacity, it's being inspected using the SP001 standard instead, and stated that therefore, the next inspection is not yet due <br /> for this tank. <br /> REGULATION GUIDANCE: (a)Except as provided in subdivision (b),the owner or operator of a storage tank at a tank <br /> facility subject to this chapter shall prepare a spill prevention control and countermeasure plan applying good engineering <br /> practices to prevent petroleum releases using the same format required by Part 112 (commencing with Section 112.1)of <br /> Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations, including owners and operators of tank facilities not <br /> subject to the general provisions in Section 112.1 of those regulations.An owner or operator specified in this subdivision <br /> shall conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1) <br /> of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control and <br /> countermeasure plan, an owner or operator specified in this subdivision shall fully comply with the latest version of the <br /> regulations contained in Part 112(commencing with Section 112.1)of Subchapter D of Chapter I of Title 40 of the Code of <br /> Federal Regulations. <br /> CORRECTIVE ACTION: Immediately prepare and implement an SPCC Plan in accordance with 40 CFR Part 112,which <br /> includes all aboveground petroleum storage containers 55 gallons or larger. A copy of this plan shall be maintained on-site, <br /> as required.
