LEA -2017-01 <br />PUBLIC RESOURCES CODE <br />(§§ 44014(b)) , CALIFORNIA CODE OF <br />REGULATIONS, TITLE 14, (§§17863) <br />TO: Harvest Power California, LLC (operators), 916 W. Frewert Road, Lathrop, CA <br />95330, and James E. and Patricia L. Sanchez (owners), 8700 Woodward Lake Dr., Oakdale, CA <br />195361: <br />PLEASE TAKE NOTICE THAT: <br />WHEREAS, Harvest -Lathrop ("Facility"), a solid waste facility located at 920 W. <br />Frewert Road, Lathrop, 95330 California (APN 19126022); and <br />WHEREAS, the San Joaquin County Environmental Health Department ("EHD") has <br />authority to act in the capacity of enforcement agency (LEA) for this Facility pursuant to Public <br />Resource Code (PRC) §43200 et seq., and is so acting; and <br />WHEREAS, the Harvest Power California, LLC is operating a solid waste facility that is <br />permitted to operate pursuant to Solid Waste Facility Permit ("SWFP") No. 39 -AA -0051, issued on <br />July 18, 2014 (Attached under Exhibit A); and <br />WHEREAS, EHD notified Harvest Power California, LLC that the Facility is in violation <br />of the PRC, a regulation adopted pursuant to the PRC, or an order issued under the PRC in <br />inspection report issued on December 22, 2016, for inspection conducted on December 9, 2016. <br />Facility was cited for a violation of PRC 44014(b) which requires facility to comply with terms <br />and conditions of the SWFP.
