The Facility was required to reduce the onsite volume by 15,000 cubic yards by March 30, <br />2 2017, and an additional 15,000 cubic yards by April 30, 2017, (Email attached under "Exhibit <br />3 J"). . <br />4 WHERAS, on February 28, 2017, Sam Monaco of Harvest Power California, LLC, <br />5 emailed documentation stating that 5,656 tons green waste from customers had been diverted <br />6 from the facility and 2,056 tons of green waste had been removed from the site (Attached under <br />7 Exhibit K). WHEREAS, on March 28, 2017, EHD conducted an inspection of the Facility which <br />8 revealed that the amount of material on site remained in excess of 100,000 cubic yards, and piles <br />9 of material on site remained in excess of 250 feet in length. Facility was given an area of <br />10 concern for not complying with permit terms and conditions (PRC 44014(b)) for design capacity, <br />11 and pile dimensions. The Facility remained unable to grind and place waste into windrows <br />12 within 72 hours of receipt. A violation was cited for T14 CCR, Section 17863, for failing to <br />13 comply with Facility's ReportCompostingSiteInformation(RCSI)in which it states that waste <br />14 entering the Facility will be ground and incorporated into windrows within 72 hours of receipt <br />15 (RCSIattached under Exhibit M). An area of concern was given for T14 CCR, Section <br />16 17867(a)(3), due to presence of off site litter in adjacent field and lack of bait stations on site <br />17 (Inspection report attached under Exhibit L). <br />18 WHEREAS, on March 27, 2017, Sam Monaco, of Harvest Power California, LLC <br />19 requested a meeting with EHD (Email attached under Exhibit N). <br />20 WHEREAS, on March 29, 2017, Robert McClellon, Michael Kith and Harprit Mattu of <br />21 the EHD staff met with Sam Monaco to clarify the applicable requirements pursuant to PRC, <br />22 Section 45010.2, and to determine what actions, if any, that the owner or operator may <br />23 voluntarily take to bring the Facility into compliance. Facilty was given deadline of April 30, <br />24 2017, to reduce the amount of material on site to below 100,000 cubic yards, and reduce pile <br />25 dimension to less than 250 feet in length (Inspection Report for March 28, 2017 attached under <br />26 Exhibit L). <br />27 <br />-4- <br />
