1 3. Piles of material on site exceed 250 feet in length. <br />2 4. Timeframe for processing waste from date of receipt as feedstock to date of removal <br />3 from facility as finished product exceeds 6 months. <br />4 The above change(s) in design and/or operation constitutes a violation of PRC §44014(b), <br />5 which requires the operator to comply with the terms and conditions in an approved SWFP. <br />6 WHEREAS, ongoing violations in the operation of this Facility have been documented <br />7 since December 9, 2016, which include: <br />8 1. PRC 44014(b) — Facility non-compliant with terms and conditions listed in the SWFP <br />9 including: exceeding site design capacity of 100,000 cubic yards, storing piles of <br />10 material at lengths greater than 250 feet in length, and exceeding 6 month timeframe <br />11 for receiving material as waste and removing it from the site as finished product. <br />12 2. TITLE 14 CCR, SECTION 17863 — Facility non-compliant with requirements listed in <br />13 facility RCSI. Facility is not processing and placing green waste into windrows within <br />14 72 hours of receipt as stated in facility RCSI. <br />15 THEREFORE, PURSUANT TO PRC SECTIONS 45000, 45011, AND CALIFORNI <br />16 CODE OF REGULATIONS TITLE 14 SECTIONS 18304 AND 18304.1, Harvest Power <br />17 California, LLC IS ORDERED TO: <br />18 1. Reduce the amount of material on site to 100,000 cubic yards or less by November 10, <br />19 2017. <br />20 2. Reduce the dimension of piles on site to comply with permit terms and conditions <br />21 requiring piles to be no more than 250 feet in length, 150 feet in width, and 25 feet in <br />22 height by November 10, 2017. <br />23 3. Reduce timeframe for processing waste from date of receipt, as feedstock, to date of <br />24 removal from facility, as finished product, to 6 months or less by November 10, 2017. <br />25 4. Comply with facility procedures outlined in RCSI, specifically regarding the grinding <br />26 and incorporating of waste into windrows within 72 hours of receipt by November 10, <br />27 2017 <br />-7- <br />
