The following is an itemized list of underground storage tank violations that have not <br />been addressed for STOP N SHOP as of February 09, 2021. <br />Open violations from August 31, 2020 inspection <br />Violation #101 - Failed to obtain a permit to operate from the EHD including but not limited to unpaid permit <br />fees. <br />OBSERVATION: A permit to operate the UST system has not been issued. Per Ahmed Muthanna, he has been the <br />new operator for this site for approximately 11 months. Property owner Fahmi Alsumeri also confirmed the change <br />in operator but could not confirm a date. <br />REGULATION GUIDANCE: No person may own or operate an UST unless a permit for its operation has been <br />issued by the local agency to the owner or operator of the UST system. <br />CORRECTIVE ACTION: Immediately obtain a permit to operate a UST system from the EHD. An "Operating <br />without a Permit" penalty applies. <br />❑ This violation was corrected ❑ This violation will be corrected by (date): <br />❑ Supporting documents included <br />Describe actions taken or will be taken to correct violation: <br />Violation #102 - UST operating permit application for facility and tank information not submitted or current. <br />OBSERVATION: The UST Facility Operating Permit is not current in CERS. A UST Facility Operating Permit has <br />not been updated to reflect the change in tank operator. <br />REGULATION GUIDANCE: Any change of information must be updated in the California Environmental Reporting <br />System (CERS) within 30 days of the changes. <br />CORRECTIVE ACTION: Immediately log into CERS, update the required information, and submit for review by the <br />EHD. <br />❑ This violation was corrected ❑ This violation will be corrected by (date): <br />❑ Supporting documents included <br />Describe actions taken or will be taken to correct violation: <br />Violation #105 - Failed to have an approved UST response plan. <br />OBSERVATION: The response plan is not current and/or not approved by the EHD. The responsible persons listed <br />is not current and the response plan is not signed by the current owner/operator. <br />REGULATION GUIDANCE: The response plan must be uploaded to the California Environmental Reporting System <br />(CERS). <br />CORRECTIVE ACTION: Immediately log into CERS, upload the completed form, and submit for review by the EHD. <br />Page 1 of 9 <br />
