Reissued Waste Discharge Requirements General Order R5-2013-0122 11 <br /> Existing Milk Cow Dairies <br /> 35. Participation in an Environmental Stewardship Program or operation of a dairy in a <br /> county that has a local ordinance regulating dairies may assist an existing dairy <br /> facility in meeting the requirements of this Order but these programs are not a <br /> substitute for regulation under this Order. <br /> GENERAL FINDINGS <br /> 36. This Order does not authorize violation of any federal, state, or local law or <br /> regulation. <br /> 37. As stated in Water Code section 13263(g), the discharge of waste into waters of <br /> the state is a privilege, not a right, and this Order does not create a vested right to <br /> continue the discharge of waste. Failure to prevent conditions that create or <br /> threaten to create pollution or nuisance will be sufficient reason to modify, revoke, <br /> or enforce this Order, as well as prohibit further discharge. <br /> 38. In compliance with Water Code section 106.3, it is the policy of the State of <br /> California that every human being has the right to safe, clean, affordable, and <br /> accessible water adequate for human consumption, cooking, and sanitary <br /> purposes. This order promotes that policy by requiring discharges to meet <br /> maximum contaminant levels designed to protect human health and ensure that <br /> water is safe for domestic use. <br /> 39. This Order is not a National Pollutant Discharge Elimination System Permit issued <br /> pursuant to the Federal Clean Water Act. Coverage under this Order does not <br /> exempt a facility from the Clean Water Act. Any facility required to obtain such a <br /> permit must notify the Central Valley Water Board. <br /> 40. The Findings of this Order, supplemental information ancdetails in the attached <br /> Information Sheet, and the administrative record of the Central Valley Water Board <br /> relevant to milk cow dairies, were considered in establishing the conditions of <br /> discharge. <br /> 41. In 2006, the Central Vallepater Board, the State Water Board, and Regional <br /> stakeholders began a joint effort to address salinity and nitrate problems in the <br /> region and adopt long-term solutions that will lead to enhanced water quality and <br /> economic sustainability. Central Valley Salinity Alternatives for Long-Term <br /> Sustainability (CV-SALTS) is a collaborative basin planning effort aimed at <br /> developing and implementing a comprehensive salinity and nitrate management <br /> program. The CV-SALTS effort might effect changes to the Basin Plans that would <br /> necessitate the re-opening of this Order. <br /> 42. The Central ValleyWater Board recognizes that the 2007 General Order imposed <br /> new and more stringent requirements on existing milk cow dairies. This Order is <br />
