Reissued Waste Discharge Requirements General Order R5-2013-0122 12 <br /> Existing Milk Cow Dairies <br /> intended to enhance the requirements imposed under the 2007 General Order. <br /> However, some revisions to this Order may be necessary in the future to address <br /> issues that are not presently foreseen. The Executive Officer will provide annual <br /> updates to the Central Valley Water Board on the overall compliance with the <br /> Order and make recommendations for revisions to the Order if necessary. <br /> 43. The Central Valley Water Board has notified interested agencies and persons of its <br /> intent to issue this Order for discharges of wastes from existing milk cow dairies, <br /> and has provided them with an opportunity for a public hearing and an opportunity <br /> to submit comments. <br /> 44. The Central Valley Water Board, in a public meeting, heard and considered all <br /> comments pertaining to the proposal to regulate discharges of wastes from existing <br /> milk cow dairies under this Order. <br /> IT IS HEREBY ORDERED that, pursuant to Water Code sections 13260, 13263, and <br /> 13267 and in order to meet the provisions contained in Division 7 of the California Water <br /> Code and regulations and policies adopted thereunder; all Dischargers specified by the <br /> Central Valley Water Board and all Dischargers that were formerly regulated under the <br /> original version of Order R5-2007-0035 adopted in May 2007, their agents, successors, <br /> and assigns shall comply with the following: <br /> A. PROHIBITIONS <br /> 1. The discharge of hazardous wastes, as that term is defined in California Code <br /> of Regulations, title 22, section 66261.1 et seq., is prohibited. <br /> 2. Except when authorized by a National Pollutant Discharge Elimination <br /> System (NPDES) permit, the direct or indirect discharge of waste and/or <br /> storm water from the production area to surface waters is prohibited. <br /> 3. The discharge of waste from existing milk cow dairies to surface waters which <br /> causes or contributes to an exceedance of any applicable water quality <br /> objective in the Basin Plans or any applicable state or federal water quality <br /> criteria, or a violation of any applicable state or federal policies or regulations <br /> is prohibited. <br /> 4. The collection, treatment, storage, discharge or disposal of wastes at an <br /> existing milk cow dairy shall not result in the creation of a condition of <br /> pollution or nuisance2. <br /> ' Discharges of pollutants from the production area to waters of the United States may not lawfully occur except in <br /> compliance with a National Pollutant Discharge Elimination System (NPDES) permit. NPDES permit coverage is not <br /> provided by this Order, but must be obtained separately. <br /> 2 Except in circumstances where a Discharger is making improvements to waste management practices that have <br />
