CONDITIONS OF APPROVAL <br /> PA-2100022 <br /> JATINDER DHILLON/40FORTY, LLC <br /> Use Permit Application No. PA-2100022 was approved by the Planning Commission on March 3, 2022. <br /> The effective date of approval is March 13,2022.This approval will expire on September 12,2023,which <br /> is eighteen (18) months from the effective date of approval, unless(1)all Conditions of Approval have <br /> been complied with, (2) all necessary building permits have been issued and remain in force, and (3) <br /> all necessary permits from other agencies have been issued and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT(Contact: [209]468-3121) <br /> a. APPROVED USE: A Use Permit for a Small Winery and Brewery to be constructed in 2 phases over <br /> 5 years, as shown the site plan dated August 24, 2021. (Use Type: Wineries and Wine Cellars — <br /> Winery, Small; Agricultural Processing—Food Manufacturing) <br /> • Phase 1: (with building permits to be issued within 18 months of the effective date of approval): <br /> o Construction of a 4,000-square-foot wine production and beer production building <br /> o A 3,000-square-foot tasting room for wine and beer, with outdoor seating area <br /> o Demolition of the existing single-family home and agriculture structures <br /> • Phase 2: (with building permits to be issued within 5 years of the effective date of approval): <br /> o Construction of a 4,000-square-foot multipurpose building <br /> o A 4,000-square-foot beer and wine production building <br /> b. BUILDING PERMIT: Submit an "APPLICATION-COMMERCIAL BUILDING PERMIT'. The Site Plan <br /> required as a part of the building permit must be prepared by a registered civil engineer or licensed <br /> architect. This Plan must show drainage, driveway access details including gates, on-site parking, <br /> landscaping, signs, existing and proposed utility services, and grading (refer to the "SITE PLAN <br /> CHECK LIST'for details). Foundation and soils investigation shall be conducted in conformance with <br /> Chapter 18 of the California Building Code at the time of permit application. A fee is required for the <br /> Site Plan review. (Development Title Section 9-884) <br /> c. PERMITTED EVENTS: Events are subject to the following regulations: <br /> 1. Marketing Events: A maximum of 12 marketing events are permitted annually with a maximum of <br /> 120 attendees, as specified in the Marketing Plan dated August 24, 2021. <br /> Marketing events must end by 10:00 p.m. (Development Title Section 9-1075.9[]) <br /> 2. Small-scale Accessory Winery Events: A maximum of 1 daily with a maximum of eighty (80) <br /> attendees. <br /> 3. Wine Release Events: A maximum of four [4] annually with a maximum of 120 attendees at <br /> any given time. <br /> d. MARKETING CALENDAR: A Marketing Calendar shall be filed with the Community Development <br /> Department and updated as required for any winery or off-site wine cellar with approve Marketing <br /> Events,Accessory Winery Events,Wine Release Events and/or Industry Wide Events. <br /> PA-2100022—Conditions of Approval 1 <br />
