The missing receipts include: <br /> -10/21/2019 for 360 gallons of used oil <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Immediately locate a copy of all consolidated manifest receipts for all hazardous waste for <br /> the past three years. Maintain the records on-site for three years from the date of shipping and provide a copy to <br /> the San Joaquin County Environmental Health Department(EHD). If the receipts cannot be found, provide a <br /> statement to the EHD that future receipts will be maintained on-site for three years. <br /> This is a Class II violation. <br /> 119 HSC 25404(e)(4) Failed to report program data in the California Environmental Reporting System (CERS). <br /> OBSERVATION: This business's hazardous waste activities have not been reported on the California <br /> Environmental Reporting System (CERS)website. <br /> REGULATION GUIDANCE: Each regulated business shall report program data electronically on the CERS <br /> website. <br /> CORRECTIVE ACTION: Immediately report your business activities including the hazardous waste program on the <br /> CERS website. Provide a corrective action statement to the San Joaquin County Environmental Health Department <br /> within 30 days. <br /> This is a Class II violation. <br /> 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br /> OBSERVATION: The following oily spills were observed: <br /> -An oily spill was observed by the new oil totes in the chemical storage area <br /> -Dark staining was observed on the dirt/rocks in front of the metal shop <br /> -Dark staining was observed on the dirt west of the"carport"area <br /> REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment. <br /> CORRECTIVE ACTION: Immediately clean up the oily spills. Manage the waste according to Title 22 California <br /> Code of Regulations for hazardous waste.
