Environmental Health Department <br />AMENDED <br />4/6/2021 <br />Hazardous Materials Program Inspection Report <br />Date: <br />April 06, 2021 <br /> Facility Address: <br /> 3028 NAVY DR, STOCKTON <br /> Facility Name: <br /> PACIFIC ETHANOL STOCKTON LLC <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 7 HSC 25505(a)(3) Failed to electronically submit an adequate ER procedures for a release or threatened release. <br />OBSERVATION: The emergency response(ER) procedures were not submitted to CERS annually. The ER <br />procedures were not submitted for 2021 calendar year. <br />REGULATION: A business plan shall include the following emergency response procedures for a release or <br />threatened release of hazardous materials, including, but not limited to, the following: <br /> - immediate notification of local emergency personnel and the Environmental Health Department (EHD) <br /> - procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment <br /> - evacuation plans and procedures, including immediate notice, for the site <br />VIOLATION CORRECTED ONSITE. <br />This is a Class II violation. <br /> 8 HSC 25505(a)(4) Failed to establish and electronically submit a reasonable or an adequate training program. <br />OBSERVATION: A training program was not submitted to CERS annually. The training program were not <br />submitted for 2021 calendar year. <br /> <br />REGULATION: Training programs for all employees and annual training, including refresher courses, shall include <br />familiarity with the facility's Emergency response plans and procedures in the event of a release or threatened <br />release of a hazardous material. Training shall cover, but not limited to, all of the following: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />These training programs may take into consideration of each employee.
