SANJOAQUIN <br />COUNTY— <br />Environmental Health Department <br />Underground Storage Tank Program Inspection Report <br />Facility Name: <br />Facility Address: <br />Date: <br />Nella Oil #427 <br />3300 Waterloo Rd, Stockton <br />December 09, 2021 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />Item # <br />Remarks <br />214 <br />CCR 2712 Failure to comply with UST operating permit conditions. <br />OBSERVATION: The 87 leak detector was replaced on 1/13/2020 and a permit was not obtained from the EHD. <br />REGULATION GUIDANCE: Emergency repairs relating to UST system monitoring and release detection may be <br />performed by a properly licensed, trained, and certified contractor pursuant to the EHD's policy and a permit <br />obtained within one business day from the EHD. All other repairs must have a permit submitted to and approved by <br />the EHD prior to beginning work. <br />CORRECTIVE ACTION: Immediately obtain a permit from the EHD for the 87 leak detector replacement. A "Failure <br />to Obtain a Permit" penalty applies. <br />This is a repeat violation, Class II. <br />318 <br />CCR 2635, 2637.1, 2665, 2712 Failed to meet spill container requirements. <br />OBSERVATION: The 87 direct -bury spill container failed when tested. <br />REGULATION GUIDANCE: All spill containers shall have a minimum capacity of five gallons and be capable of <br />containing a spill or overfill until it is detected or cleaned up. <br />CORRECTIVE ACTION: Immediately discontinue deposition of petroleum into this tank until the component is <br />repaired or replaced by a properly licensed, trained, and certified contractor under permit and inspection of the EHD. <br />If the spill container can't be replaced immediately, there is a possibility that the 87 UST system may be red tagged <br />to prevent fuel inputs. <br />This is a Class II violation. <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by 1/8/2022. <br />To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br />of having them sign. Starting September 1, 2018, all in -office CERS help will be provided at EHD hourly rate <br />($152).
