I Mitigation Monitoring Program (MITIGATION MONITORING AND REPORTING PROGRAM: CONSOLIDATED FORWARD LANDFILL PROJECT). The applicant and the Community Development Department shall annually review the program. Not less than 30 days nor more than 60 days prior to the first anniversary date of this approval, and each anniversary date thereafter,the applicant shall submit to the Community Development Department a letter setting forth the applicant's good faith compliance with the terms and conditions of the program. Community Development Department staff will visit the site semi-annually. All costs incurred by the Community Development Department for the semi-annual monitoring and the annual review shall be bome by the applicant. The costs may include costs of Community Development Department staff and administrative time and direct out-of-pocket costs and expenses, including costs of consultants and non-department personnel. Community Development Department staff time may include overhead costs and will be consistent with Department policy. g. MITIGATION MEASURES: The following mitigation measures identified in the Final Environmental Impact Report: Consolidated Forward Landfill Project(SCH#2001052081), November 2002 are adopted as conditions of approval: NOISE (1) 6 (C.3) Identified in EIR: (a) Heavy equipment operations shall not be conducted within 1500 feet of any occupied residence after 10 p.m. and before 6 a.m.; or (b) Equipment operations within 1500 feet of any residence after 10 p.m. or before 6 a.m. shall be fully shielded from the direct line of sight to the residence by an earthen berm whose crown elevation exceeds the elevation of the top of the exhaust stack. (2) 7 Forward 1993(E3) The landowner and tenant at R 1 (residence at 9690 Austin Road)shall be provided with the option of requesting a sound wall to reduce noise exposure both in the front yard and within the home. Table lll.E.Bin the Draft EIR shows the noise reduction provided by a variety of different sound wall designs. The footnotes to Table III.E.B describes the alternative designs in detail). Note that any of these designs will be more than sufficient to reckice project noise impacts below a level of significance. (5) 10 Austin 1994(H1.a)(similar),Austin 2000(H1.a) The proposed project must conform to the San Joaquin County Noise Standards contained in the County's General Plan. The project sponsor shall be required to demonstrate compliance with this performance standard. Work areas could be limited, work times dose to the residence could be rescheduled,noise barriers such as earth berms could be designed, and noise monitoring shall be undertaken to demonstrate compliance in the event noise complaints are received.
