This letter summarizes activity since our preliminary EMP <br /> report of late January and our recent conversation. <br /> The Order addressed two issues: The evaluation monitoring plan to assess the extent of groundwater impact <br /> and closure of the areas containing refuse that are not now provided with closure cap. <br /> Evaluation Monitoring Plan (EMP) <br /> The second set of groundwater monitoring wells were drilled and sampled in the week of February 24, 2012, <br /> for a total of six sampling points to date. We expect the analyses from the February wells in the third week of <br /> March. Hopefully these data will allow us to establish the extent of release and complete the Evaluation <br /> Monitoring Program and Engineering Feasibility Study. <br /> We were fortunate that we had both Vector(now Geologic)and Gregg Drilling under contract when the Order <br /> was issued so that we could immediately direct their efforts to this component of the Order. <br /> Landfill Closure <br /> Plans and specifications for the Final Cover Expansion Design were delivered to RWQCB staff on October 9, <br /> 2011 in accordance with Item 1 on page 5 of the Order. These documents reflected the conceptual design <br /> approved by RWQCB staff in 2008 and we anticipated that the detailed design would be quickly approved, <br /> and with luck, construction could occur in 2012. As with Vector and the EMP,we had a contract in place with <br /> Shaw Environment and Infrastructure(Shaw), and we immediately applied that resource design upon receipt <br /> of the Order. However, this design was found not to be acceptable based on technical grounds, and we are <br /> therefore preparing to re-design closure of this landfill. <br /> Unfortunately, our contract budget with Shaw was consumed in the preparation of the plans and specifications <br /> submitted October 9 and related work and discussion with the RWQCB permitting unit, and we are not able to <br /> extend this contract again. <br />
