Board Staff with the Title 27 Permitting Section has reviewed the submittals <br /> and has prepared the following comments: <br /> 1. Slope Stability Analysis Report: A slope stability analysis report dated 5 April 2012 <br /> (hereafter"Report")was submitted to Board Staff for review and acceptance. Board staff <br /> primarily relies upon the competence of the Discharger and/or its consulting firm to prepare a <br /> Report that meets the requirements of Title 27 Section 21090(a) and Section 21750(f)(5). In this <br /> instance, the engineering firm (Shaw Environmental, Inc.) (herafter"Consultant") in their <br /> Disclaimer/Limitations section in the Report made the following statement: <br /> "This report is solely for the use and information of our client unless otherwise noted. <br /> Any reliance on this report by a third party is at such party's sole risk. Opinions and <br /> recommendations contained in this report apply only to conditions existing when <br /> services were performed and are intended only for the client, purposes, locations, <br /> time frames, and project parameters indicated." <br /> In this instance, the Regional Board would be considered a "third party' based on the disclaimer <br /> above and therefore, the Consultants certification/approval of the slope stability analysis could <br /> not be used in revising the Waste Discharge Requirements (WDRs). The design approval by a <br /> registered professional, which includes stability analysis, is required under Title 27.
