Environmental Health Department <br />Small Quantity Hazardous Waste Generator Inspection Report <br />Date: <br />April 27, 2021 <br /> Facility Address: <br /> 6649 S TRACY BLVD, TRACY <br /> Facility Name: <br /> TRACY WATER TREATMENT - PRIMARY <br />Other Violations <br /> 3050 □ V □ R □ COSUnlisted Abandonment/Illegal Disposal/Unauthorized Treatment violation See below <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br />OBSERVATIONS: Two full 55 gallons poly drums with no labels, one 30 gallon drums with approximately 3 gallons <br />of liquid, two pallets of paint, aerosol cans and chemical adhesive were found on site by the maintenance shop. <br />Per Keeneth Merkle, Maintenance Superintendent, all these chemicals are wastes. <br />REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br />as specified in Title 22 California Code of Regulations (CCR). There are wastes that are listed as hazardous <br />wastes. There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive <br />or ignitable. <br />Title 22 CCR section 66261.2 – Definition of Waste <br />Title 22 CCR section 66261.3 – Definition of Hazardous Waste <br />CORRECTIVE ACTION: Submit a statement and supporting documentation with your hazardous waste <br />determination. Demonstrate current storage and labeling for wastes determined to be hazardous wastes. Provide <br />disposal records for wastes determined to be hazardous wastes and stored longer than the number of days <br />specified in Title 22 CCR for your hazardous waste generator status. <br />This is a Class II violation. <br /> 113 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. <br />OBSERVATION: The facility could not provide all of the consolidated manifest receipts for hazardous waste <br />transported from the site in the past three years. The missing receipts include the waste removed from the part <br />washer for the last three years( 4/27/2018-4/27/21). <br />REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br />This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br />the regulated activity or as requested by the department or a certified unified program agency. <br />CORRECTIVE ACTION: Immediately locate a copy of all consolidated manifest receipts for all hazardous waste for <br />the past three years. Maintain the records on-site for three years from the date of shipping and provide a copy to <br />the San Joaquin County Environmental Health Department (EHD).
