Laurie Cotulla <br />August 4, 1993 <br />Page 2 <br />Marlowe Properties has done all it can to assist the County in its efforts. <br />Jonathan Marlowe provided Ms. Meays with a list of current and former <br />tenants on the property. He also asked that the neighboring owners similarly <br />be requested to provide a current and former tenant list and that a hazardous <br />substance inventory be obtained for several businesses nearby which might <br />reasonably be thought to be using or have used solvents i.e., California Cedar <br />Products Company (wood stain and metal saw research and fabrication), Sust <br />Manufacturing Company (machine work fabrication), O'Reilly and Sons (steel <br />fabrication) and Triple "S" Truck and Trailer Repair. The County is <br />apparently asking it to do more, i.e. reimburse the County for its costs. <br />I spoke with Ms. Meays several weeks ago regarding these costs. She <br />graciously forwarded to me the materials which she feels justify the <br />imposition of regulatory costs upon Marlowe Properties. I do not believe any <br />of the materials Ms. Meays mentioned or forwarded to me justifies Marlowe <br />Properties assuming the obligation to investigate someone else's release of a <br />hazardous substance. The County's "Site Mitigation Acknowledgement/ <br />Request for Services Form" is addressed to "responsible parties." Marlowe <br />Properties simply is not a responsible party with respect to the solvent <br />contamination. <br />Should your conclusions be otherwise, please let me know. My clients, <br />have been carbon copied on a number of recent laboratory sampling <br />communications which were obtained from neighboring properties but were <br />identified as the Marlowe Properties site. My clients are understandably <br />concerned that the County simply assumes that the Marlowes have agreed to <br />pay for everything. They have not. Given the existing facts I see no reason <br />why they should.
