i <br /> SUPPLEMENTAL AGREEMENT <br /> THIS SUPPLEMENTAL AGREEMENT, made and entered into this <br /> day of , 1979, by and between the <br /> CITY OF LODI, (hereinafter "CITY") , and SAN JOAQUIN COUNTY, <br /> (hereinafter "COUNTY") ; <br /> WITi`rESSETH: <br /> WHEREAS, CITY AND COUNTY have title to certain real and <br /> personal property located at 14750 East Harney Lane, Lodi, <br /> California, known as HARNEY LANE LANDFILL, (hereinafter <br /> "LANDFILL") ; and <br /> WHEREAS, by Agreement dated January 2, 19751 (hereinafter <br /> "AGREEMENT") CITY AND COUNTY provided that COUNTY would assume <br /> the sole responsibility for the operation, maintenance and <br /> supervision of the LANDFILL; and <br /> WHEREAS, the Solid Waste Facility Permit No. 39-AA-003, <br /> issued by San Joaquin Local Health District to the .LANDFILL <br /> pursuant to guidelines established by State Solid Waste Manage- <br /> ment Board for landfills, requires development of a Final Site <br /> Plan (hereinafter "PLAN") ; <br /> NOW, THEREFORE, it is agreed that: <br /> 1. The PLAN being developed shall be reviewed by CITY and <br /> COUNTY. CITY shall have input to the PLAN but shall not have the <br /> right to veto the final County-proposed PLAN. <br /> 2. At such time as the PLAN is approved by CITY and COUNTY <br /> and the LP14DFILL conforms to the PLAN, monitoring of the LANDFILL <br /> shall be implemented consistent with the PLAN and as specified in <br /> the Waste Discharge Requirements Order No. 78-147 by the California <br />
