Gro ter: The determination on this criterion is deferred <br /> until an evaluation is made of the monitoring system <br /> and concurrence is obtained from the SWRM and the <br /> RWQCB. r-o u n <br /> C. Safety/Gas: Further investigation is needed to determine that <br /> methane gas is not migrating past the property boundary, <br /> because of the proximity of offsite structures. <br /> The SWMB is providing a grace period of three months beginning with the date of <br /> this letter for you to correct the RCRA non-conpliance determinations noted above. <br /> If you take advantage of this opportunity to upgrade your site you must notify the <br /> Sms in writing of the corrective actions taken before the end of the grace period <br /> and request a re-evaluation. Upon this notification, Board staff will schedule a <br /> re-evaluation of your site for all RCRA criteria except those classified as <br /> needing further investigation. <br /> Sites not requesting a re-evaluation before the expiration of the grace period, <br /> and sites failing to meet the criteria at the requested re-evaluation, are <br /> subject to inclusion on the Open Dump Inventory list that will be sent to the <br /> 1hvironmental Protection Agency and published in the Federal Register. <br /> Further investigation is required in order to make a determination for the three <br /> indeterminate criteria. When the evaluation of the indeterminate criteria is <br /> completed you will be notified of the result in writing and if non-compliance with <br /> RCRA is noted a three -month grace period will start at that tine. <br /> If there are any questions on the results of these evaluations please contact <br /> Barry DbGee at (916) 322-0458. <br /> Sincerely, <br /> John K.
