Mr . Tom Horton
Page No. 2
state regulations. The compliance agreement must contain an
action plan for correcting each violation and area of concern
noted above.
Each action plan must contain a description of the corrective
work to be conducted, an implementation schedule and a specific
date by which the violation or area of concern will be completely
corrected. Each action plan must also outline a program for
assuring continued compliance, including a description of the
resources, equipment, personnel and quality control measures to
be employed. It is not acceptable to simply state that you will
henceforth comply with a particular standard.
As you may know, on August 18, 1989 , the State Office of Admini-
strative Law (OAL) approved emergency regulations for closure/
postclosure maintenance. Changes without regulatory effect were
also approved by OAL. These changes, although minor, will
renumber and split some existing sections of 14 CCR Chapters 3
and 5. Future inspection reports will cite the revised
regulations with their updated section numbers .
The completed compliance agreement, as approved in writing by
your LEA, should be received by this office for review on or
before April 16, 1990 . A follow-up inspection of the facility by
Board staff may be scheduled to verify compliance. Failure to
enter into or adhere to a compliance agreement may result in
enforcement action.
As always, your LEA and this office are available to assist you
at any point in the compliance process . If your have any
questions or comments, please call me at ( 916 ) 322-6520 or
Barbara Baker, your state enforcement agent, at (916) 322-2648 .
Your LEA contact is Jerry Wicks, San Joaquin County, Environ-
mental Health Department, who can be reached at ( 209) 468-3420 .
Sincerely,
John K. Bell, Manager
Monitoring and Compliance Section
Headquarters
JKB:BB: tk
Enclosure
cc: Jerry Wicks, Environmental Health Department
Jess Tucker , Central Valley RWQCB
Air Quality Control Board
