Box 1810 <br /> Stockton, CA 95201 <br /> SUBJECT: Completeness of Final 'Closure and Postclosure <br /> Maintenance Plans for Harney Lane SanitaryLandfill, <br /> Facility No. 39-AA-0003 <br /> Dear Mr. Horton: <br /> The California Integrated Waste Management Board (Board) received <br /> your final closure/postclosure maintenance materials on <br /> September 24, ` 1990. This plan included: Harney Lane Sanitary <br /> Landfill Final Closure and Postclosure Maintenance Plan dated <br /> September, 1990. <br /> Government Code, Section 66796.22 requires operators of solid <br /> waste landfills to prepare closure and postclosure maintenance <br /> plans for approval by the local enforcement agency, the Regional <br /> Water Quality Control Board, and the Boards Government Code, <br /> Section 66796.22(b) (2) does not allow the operation of a_ solid <br /> waste landfill without an approved closure and postclosure <br /> maintenance plan for more than one year beyond the date the plan <br /> is due. Title 14, California Code of Regulations (14 CCR) , <br /> Section 18255(b) (2) prohibits the implementation of any. closure <br /> or postclosure activity prior to plan approval. <br /> Based on a review for completeness, the final closure/postclosure <br /> maintenance plan for ''Harney Lane Sanitary Landfill is deemed <br /> incomplete and `rejected for filing. At a minimum, the final <br /> closure plan must include the items listed in 14 CCR 18262.3 and <br /> be based on the closure standards found in 14 CCR, Chapter 3, <br /> Article 7.8. Postclosure maintenance for the facility must <br /> include at least the items found in 14 CCR 18265.3. Public <br /> Resources Code sections 400`00 et seq. gives the Board independent <br /> authority to regulate and impose requirements on solid waste <br /> facility operators. Compliance with the requirements of another <br /> regulatory agency does not satisfy an operato'r's legal duty ,to <br /> comply with regulatory requirements promulgated by this Board. <br /> Board staff will not proceed with the review of the submittal <br /> until corrections to the following omissions in the closure and <br /> postclosure maintenance plan are submitted: <br /> t <br />
