OBSERVATION According to disposal receipts providetl to the SJC EHD from the facility the facJity deposed of the following hazardous wastes at the San Joaquin County Householtl Hazardous Wasfe Facility as a hpuseholtl instead of as a business - On 5/ 272021 4 gallons antl 3 quarts of paint - On 6 / 102021 133 pounds of tlry grinding material ( metal floor sweepings ) . 10 gallons of od , 10 gallons Cf an0lreeze . and 15 gallons of oillcoolant mixetl REGULATION GUIDANCE California Health antl Safely Code ( HSC ) § 25218 . 1 ( a ) ' Conditionally exempt small quantity generator " or " CESQG " means a generator that meets the criteria spacifietl in Section 261 5 of Title 40 of the Code of Fetleral Regulations , as that section read on January 1 . 2015 HSC § 25218 3 . ( a ) The tlepartment may authorize any household hazardous waste collection facility to acwpt hazartlous waste from ontlnipnally exempt small quantify generators ( b ) A household hazartlous waste collection facility which is authorized to aaept hazardous waste from CESOGs pursuant to subdivision ( a ) shall not accept more than 100 kilograms of hazartlous waste , or 1 kilogram of extremely hazardous waste , from any one CESgG in a calendar month HSC § 25218 . 5 ( b ) A Cpntlrtionally Exempt Small guanlity Generator ( CESQG ) transporting hazardous waste generated by tri = CESgG to a household hazardous waste collection facility shall meet all Of ilia following contlitions . ( i ) ( A ) Except as prCvitletl in subparagraphs ( B ) antl ( C ) and Section 25218 . 51 . the total amount of householtl hazardous waste transported by an indmtlual or hazartlous waste transported by a CESQG to a hpusehold hazardous waste collection facility shall not exwed a total hgwtl volume of five gallons pr a total dry weight or 50 pountls If the hazardous waste transported is both liquid antl npnhgwtl , ilia total amount transported shall hat exceetl a combined weight of 50 pounds ( B ) Subparagraph ( A) does not apply to spent batteries that are collected by B collection IocaOon Or inlermadiate lection location pursuant 1p Secbpn 25216 1 and transported to a household hazartlous waste collection faoliCy ( C ) A CESQG may transport up tp 27 gallons or 220 pountls , but not more than 100 blograms , per month to a household hazardous waste collection facility , if all of the following conditions are mel : ( i ) The hazardous waste being transported was generated by that CESgG . ( u ) The CESQG contacts the household Hazardous waste collection facJiry poor to each delivery b confirm that the facility will accept the hazartlous waste . ( ui ) The householtl hazartlous waste collection facility provides oral , written , or electronic Instructions Io the CESgG poor to each delivery pit proper packing for the safe transportation of the specific hazartlous waste being transportetl ( iv ) The CESgG or employees of the GESgG transport ilia hazardous waste in a venitle owned antl operafetl by the CESgG . ( 2 ) The household hazardous waste and CESQG hazartlous waste that is transported shall be in closed containers and packed in a manner that prevents the containers from lipping , spilling . or Dreaking during Transport . ( 3 ) DiHerem hpusehold hazardous. wastes or different CESQG hazartlous wastes shall not be mixed within a ontainer before pr during transport .
