An open unlabeled 5-gallon container was observed in the metal grinding area storing black powderAke material <br /> and debris . Ernie Lara , manager, stated that the material was waste swept up off the floor, which is disposed of in <br /> the trash . EHD took a sample of the material for metals analysis at the time of inspection . <br /> 9 <br /> 2 Two old 5-gallon containers of unknown material and at least six pails of old paint were observed outsidenear the eee� <br /> south -west corner of the facility . Ernie stated he would properly dispose of the materials. <br /> 3 According to Ernie , the facility had a spill from their parts cleaner, located in the mechaniml area , around January <br /> 2021 due to a break-in . Ernie stated he cleaned up the spill , but it was unclear how the spill was cleaned up and <br /> how the clean- up waste was managed and disposed of. Parts cleaner spill clean- up waste was not found at the time <br /> of inspection . g <br /> a <br /> REGULATION GUIDANCE : Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations ( CCR ) . There are wastes that are listed as hazardous <br /> r <br /> wastes . There are wastes that exhibit one or more of the hazardous waste charactedstics : toxic, mrtosive , reactive t <br /> or ignitable . Metal particles 100 microns or smaller in size must be handled and disposed of as hazardous waste if <br /> the metal is determined to be a hazardous waste. Metal particles larger than 100 microns in size can be recycled as s <br /> scrap metal <br /> Title 22 CCR section 66261 . 2 — Definition of Waste <br /> Title 22 CCR section 66267 . 3 — Definition of Hazardous Waste <br /> CORRECTIVE ACTION : Immediately stop disposing of the facility Floor sweepings into the trash , make a <br /> hazardous waste determination for the floor sweepings , the old containers of unknown material , old paint <br /> containers , and the parts cleaner spill clean- up waste , and manage them all according to Title 22 CCR . Use Safety <br /> Data Sheets ( SDS) , waste sampling and test results or other knowledge to support your hazardous waste <br /> determination . Waste testing must be done using methods specified in Title 22 CCR including sections <br /> 66261 . 20 -24 . <br /> Submit a statement and supporting documentation with your hazardous waste determination . Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes.
