SAN J 0 A Q I I I Irl Environmental Health Department <br /> CCUNT <br /> Hazardous Materials Program Inspection Report <br /> Facility Name: Facility Address: Date: <br /> NEW STOCKTON 99 SPEEDWAY 4105 N WILSON WAY, STOCKTON April 29, 2021 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 8 HSC 25505(a)(4) Failed to establish and electronically submit a reasonable or an adequate training program. <br /> OBSERVATION:An employee training program was lacking. <br /> REGULATION GUIDANCE: Training programs for all employees and annual training, including refresher courses, <br /> shall include familiarity with the facility's Emergency response plans and procedures in the event of a release or <br /> threatened release of a hazardous material.Training shall cover, but not limited to, all of the following: <br /> (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br /> program agency. <br /> (B)Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment. <br /> (C) Evacuation plans and procedures, including immediate notice,for the business site. <br /> These training programs may take into consideration the position of each employee. <br /> CORRECTIVE ACTION: Immediately prepare or update the facility's training program, log into the California <br /> Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, upload the correct or updated information, <br /> and submit to the EHD for approval. <br /> This is a Class II violation. <br /> 11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. <br /> OBSERVATION:A physical copy of employee training records with dates of training,training discussion points, and <br /> employee names is lacking. <br /> REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel <br /> receive initial and annual refresher training.All employees shall be trained in safety procedures in the event of a <br /> release or threatened release of a hazardous material, including, but not limited to,familiarity with the following <br /> plans and procedures: <br /> (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br /> program agency. <br /> (B)Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment. <br /> (C) Evacuation plans and procedures, including immediate notice,for the business site. <br /> This training shall be documented electronically or by hard copy and shall be made available for a minimum of three <br /> years. <br /> CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the <br /> training records to the EHD. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> An inspection checklist was provided to the facility operator on the day of inspection.
