Anything in excess of these costs should be held in a trust fund for remediation of the groundwater pollution problem. The difference between a sale by San Joaquin County and a sale by GGFF would be that a sale by the County would result in more money for the protection of San Joaquin County groundwater. A sale by GGFF would result in more money for GGFF which no longer operates in the State of California. The Regional Board would be willing to discuss a waiver of liability for future purchasers of the site. Currently, GGFF has offered to sell the property under terms which appear to be far less favorable than those which could apply should the County foreclose on the property. We are not inclined to accept such a proposal from GGFF if there is a much better alternative, particularly one in which the proceeds of the sale remain in San Joaquin County rather than being exported to Canada. Your response will provide assistance in our decision regarding the current porposal by GGFF. We would like to meet with you to discuss this proposal. Both CB Commercial and the potential buyer would like to get a response from the Regional Board as soon as possible. In order to do that we would like to give the Regional Board as much information as possible regarding the possibilities.
