Your letter was in response to our letter of 24 July 1996, in which we proposed five <br /> conditions to be met before we would recommend to the Regional Board that the purchaser be granted a <br /> waiver of liability. Your response indicates that GGFF would be willing to allocate 50%of their <br /> proceeds from the sale, up to a maximum of$200,000, to meet the first four conditions. Since GGFF <br /> has not agreed to fully meet the conditions of our 24 July 1996 letter, we propose to ask San Joaquin <br /> County whether they wish to foreclose on the property and provide a better return for water quality <br /> protection. Enclosed is a copy of our letter to San Joaquin County. <br /> While GGFF does not propose to meet the conditions of our 24 July 1996 letter. we believe that it is <br /> appropriate to ask the Regional Board for their input regarding GGFF's proposal. We have tentatively <br /> scheduled an item for the Regional Board's 6 December 1996 meeting in Sacramento. We would like to <br /> have a response from San Joaquin County before we compile the agenda materials for this Board <br /> meeting. We will keep you informed of the status of this proposed agenda item. <br /> In addition to San Joaquin County's response, any information that you can provide regarding the details <br /> of the first four conditions would be helpful. Information regarding any progress toward an agreement <br /> with the federal Environmental Protection Agency would be helpful. Also, regarding the money for <br /> groundwater protection/remediation. we would like to know if you have any idea as to who would hold <br /> this money. We believe the money should be held in a trust account.
