It is our understanding that no bankruptcy proceeding has been completed and there is no active <br /> bankruptcy proceeding at this time. Golden Gate Fresh Foods is a viable entity and would like to sell <br /> the Victor Fine Foods property in Lodi. <br /> Mr. Michael Douglas proposes to purchase the property, to demolish the existing structures, and to use <br /> the property for mini-storage, a flea market, or similar non-industrial activity. The property is currently <br /> in escrow, and Mr. Douglas is seeking a release of liability from the Regional Board for the existing <br /> contamination in the soils and ground water. Mr. Douglas requested an indication of whether the <br /> Regional Board would grant a release of liability before he closes escrow or performs monitoring <br /> activities at the site. <br /> Mr. Douglas states that he will provide improvements to the site by replacing or fixing the fence, <br /> removing physical hazards such as the piping behind the main plant building, compacting soil to prevent <br /> infiltration and leaching of salt and removal of the Class 11 Surface Impoundment <br /> Emergency/Equalization Storage Basin (E/ESB).. We discussed a proposal to conduct ground water <br /> monitoring to determine what if any threat. the contaminated ground water poses to drinking water wells <br /> in the area. <br /> We also discussed the current status of pollution at the site. There was much discussion and speculation <br /> as to the current status of the pollutant plume and whether it may be decreasing in concentration or <br /> threatening previously unthreatened wells. Subsequent to our meeting I reviewed some of the <br /> monitoring data. There are three ground water zones identified under the site. These are referred to as <br /> the A. B and C zones, with A being the shallowest zone. In 1994, the Regional Board sampled some of <br /> :he site wells. A cursory review of this data indicates that the very high A-zone salt concentrations <br /> measured in i 989 on site have been reduced through pumping by Golden i=rate Fresh Foods and or <br />
