Submit a workplan to the Board and after approval regrade Pond 2, compacted to 90%- <br /> 95% and crowned to drain water and create a low permeability surface. The surface will <br /> have a permeability of less than 1 x 10-5 cm/sec. No ponding shall occur in Pond 2 after <br /> the soils are compacted and crowned. Complete the work no later than 1 January 1999 <br /> and provide a report to the Board confirming compliance with the workplan. <br /> D. Test monitoring submit a sampling and analysis plan by 1 July 1998, that shall include <br /> the analysis, and date of sampling and reporting. Based on this plan, a Monitoring and <br /> Reporting Program will be developed. Monitoring will include the extraction of several <br /> well volumes of water and then taking water samples to an approved laboratory for <br /> analysis and reporting the results to the Board. Prior to sampling, water levels will be <br /> taken in each of the monitoring wells. <br /> E. Remove wastewater in Pond 1 by 1 July 1998. Wastewater is defined as water with a <br /> total dissolved solids concentration of 500 parts per million or greater. Wastewater shall <br /> be removed and disposed of at a facility which is permitted to accept this wastewater. <br /> Provide a report to the Board confirming completion of this task. After removal of <br /> wastewater, Pond 1 may be used to contain storm water runoff. <br /> F. Close or modify the injection well as required by the federal Environmental Protection <br /> Agency, Region IX by 1 August 1999. Approved plans shall be submitted to EPA within <br /> 90 days of the property transfer. <br /> G. Complete site security improvements, including the installation or repair of the perimeter <br /> chain link fence, dismantling of the trickling filter tank and hazardous structural steel, <br /> pipes, debris and partially fire damaged structures by 1 October 1998. <br /> 3.2 Wight of Access. Douglas agrees to provide to the Board, its authorized officers, employees, <br /> representatives, and all other persons performing cleanup and abatement actions under Board oversight, <br /> access to the Site at reasonable times and in a reasonable manner to monitor and inspect the Property and <br /> to exercise its rights and responsibilities. <br /> Nothing in this Agreement shall be interpreted to limit the Board's authority under Division 7 of <br /> the California Water Code or other law to take actions to protect the public health and safety or the <br /> environment, however, Douglas' obligation to undertake cleanup and abatement actions relating to the <br /> Known Conditions is expressly limited by this Agreement. <br /> 3.3 Due Care/Cooperation. Douglas agrees to exercise due care such that activities at the <br /> Property will not aggravate or contribute to the Known Conditions and shall comply with all applica' <br /> local, state, and federal laws and regulations. Douglas agrees to cooperate fully with Board in the <br /> implementation of cleanup and abatement actions as agreed in the Agreement and to refrain from <br /> interfering with the investigation of the Property or with implementation of other cleanup and ab,- <br /> activities. <br />
